Terms of Service

Poop Genie LLC is pleased to provide professional services to our Clients.  The intention of Poop Genie LLC terms is to outline expectations by both Poop Genie LLC and Client.  These terms confirm the Client understanding of, and agreement with, both what is included with our services, our terms, our terms of payment, as well as the limitations of the services you have asked us to perform.

      1. Payment
        1. All residential services are pre-billed, which means services are paid prior to services being rendered (except acquired clients which will be post-billed accordingly if done so with previous company).
        2. For dog poop subscription service require a card on file with our third-party software company for automatic billing. During the onboarding process, all clients will receive an email/text to put a card on file.  Services will not be provided if a card is not put on file.
        3. Full payment will be processed for automatic billing on either the 1st or 15th of the month depending on enroll date.
        4. One-time services will be pre-billed through email/text. Service will not be provided if payment is not received the day before the Client service date.
        5. All commercial services are post-billed monthly unless an entire year has been paid in advance. A signed service agreement will be provided to all commercial clients and terms will be outlined there, negating the terms provided here.
        6. Payments are non-refundable. If payment is made and you decide to cancel service, Poop Genie LLC will continue to service the account until your next auto bill date.
      2. Initial Cleaning Fee
        1. For dog poop scoop service, all new clients are required to pay an additional one-time $50.00 first scoop fee.
        2. The initial cleaning fee will be waived by Poop Genie LLC if regular scooping has been performed by Client prior to our first arrival. Notice must be given by Client that regular scooping did occur so Poop Genie LLC can waive the fee.
        3. If Client states that regular scooping did occur and the first visit is over 30 minutes, the $50.00 first scoop fee with still be applied.
        4. After the first auto bill date, all first scoop fees are reconciled and billed to the card on file.
      3. Prorated Visits
        1. When a new subscribing Client starts service, some visits are performed BEFORE the first auto bill date. After the first auto bill date, all service visits performed prior are reconciled and billed to the card on file.
      4. Service Suspension/Cancellation
        1. If a payment is delinquent, service can be suspended. We will notify our Client of a suspension for non-payment.  If payment is submitted, there is no discount for missed visits as there is the same amount of poop for us to pick up and it will take more time upon reservicing.  If visits were performed after the prebilled date, and cancellation occurs, Client will be billed for these visits on a separate invoice.
        2. If either party would like to terminate the agreement, please provide a (5) day written notice via email/post mail and the service will be cancelled.
        3. Poop Genie LLC bills monthly and Client fully understands that subscription service or one-time services are paid up front and are nonrefundable.
        4. In the event that a Client is on vacation or if the dog is not present and a pause is needed, Poop Genie LLC will prorate services and pause visits. Please provide Poop Genie LLC with at least a (5) day notice and we will do our best to make sure you are not billed for service you do not receive.
      5. Service Days
        1. All clients are given a “target day” of service. While it serves in everyone’s best interest to consistently maintain the same day, many variables exist that require us to move a day.  Traditionally, we simply need to come the day before OR after your target day if a change is needed.  Poop Genie LLC will make every effort to hit the Client’s target day and we will also try to let a Client know if we are behind more than one business day.
        2. Winter Months/Inclement Weather: In the event that your service day is skipped due to inclement weather, we will provide service the following week.  There is not a refund for the skipped day because there will be twice the amount of work and it will take twice as long for our technicians.  If Poop Genie LLC misses consecutive weeks, we will contact the Client and come up with a plan to provide service as best we can.  Our employees’ safety is very important to us, which is why we will skip days if the roads are undriveable or unsafe.
        3. We try to keep our service days consistent, however, to keep our prices low, we may need to change service days from time to time to keep the routes efficient. If there is a major change, we will make every attempt to contact the Client and let them know of this change.
      6. Unanticipated Services
        1. Only the services on your invoice will be provided. If an additional service is needed, Poop Genie LLC will provide a quote for the additional work and it will be approved by Client to commence new service.
      7. Service and Price Guarantee
        1. Poop Genie LLC will always stand behind the quality and professional nature of the services that we offer. If at any point you are unsatisfied with the services provided, we encourage you to bring this to our attention immediately.  We would love the opportunity to correctly address your concerns and allow us a chance to win your trust back and prevent similar problems from happening in the future.  We will make every reasonable effort to send a technician out to reservice your property within 48 hours if there is a concern.
        2. Our service is not reliant on the time we spend on Client property. Some technicians scoop quickly and work at a fast pace, while others work slower or are new technicians.  The quality of the service is the most important factor in analyzing performance.  Discounts and cancellations are not provided if a technician works at a faster pace, but still provides the same excellent service Poop Genie LLC prides itself on.
      8. Ownership of Documents and Photos
        1. All original documents obtained through engagement shall remain the property of Poop Genie LLC.
        2. Poop Genie LLC will on occasion take video or photos while performing service on property. Client understands and agrees to grant Poop Genie LLC non-exclusive, unlimited, free right to publish and use such materials on its website, as well as for any other marketing, promotional, advertising, or other legitimate business use.  If a Client would like for no video or photos to be taken at their residence, please let us know and we will note not to do so.
        3. To protect our technicians, Client agrees to not publish any photos taken onsite by security cameras/doorbell cameras. While these cameras can be an asset, they are also a liability.  A camera not getting a picture of a technician does not mean we did not provide service.  Batteries need to be changed, the tech works fast past the camera, or bad wiring are examples of why we do not accept camera misses as proof of a non-visit.  Please walk the property and if there is service the Client thinks we did not provide, please contact us so we can resolve the concern as soon as possible.
      9. Maintaining Property
        1. Client is responsible for maintaining their property so our scope of service can be performed professionally, safely, and responsibly. It is important to understand that Poop Genie LLC technicians will only perform service to areas that are safe and accessible and free of both visible and latent hazards.  The Client will be billed for services even if their property is not accessible or poses an unreasonable risk of injury to our technicians.
        2. Along with being safe, each property must be maintained so our technicians can properly service the property. Common concerns that lead to skipped visits or poor service include:
          1. Long grass
          2. Poor drainage on property
          3. Aggressive dogs
          4. Unraked leaves
          5. Large rock landscaping
          6. Gates that do not shut or open correctly
          7. Locked gates
      10. Aggressive Dogs
        1. During our onboarding process, we will ask if your dogs are aggressive. Please understand, your dog doesn’t know us and may be friendly to friends and family, but not the stranger that walks on their turf to provide service.
        2. We text ahead before each visit and if your dog is aggressive, please let us know and we can give you extra time before we text.
        3. If aggressive dogs are in the lawn when we arrive, we will skip the visit with no refund. Our goal is to protect not only our staff, but also your dog’s well-being.
      11. Texting Ahead
        1. Poop Genie LLC will text ahead before each visit. You agree to text message service and all SMS and rates associated with receiving and sending text messages.  Poop Genie LLC is in no way responsible for applicable fees from your cell phone provider.
        2. Poop Genie LLC can only text one person for advanced notice of arrival. Client agrees to ensure that the correct number is on file.
      12. Closure Dates
        1. One-Day Holidays
          1. Poop Genie LLC will make every effort to provide service at a minimum of one day a week to weekly Clients. Twice a week Clients may receive service only one day due to the shortened week.  If the skipped service day is a Biweekly Client’s normal day, Poop Genie LLC will provide service that week.
        2. Closed Holidays
            1. Easter
            2. Memorial Day
            3. 4th of July
            4. Labor Day
            5. Thanksgiving
            6. Winter Break: December 24-January 1
              1. Poop Genie LLC provides a weeklong break so our employees can enjoy some time with their family. We will make every opportunity to make sure no customer goes on longer than two weeks without service before and after this timeframe. A refund will not be provided for this break and we will follow the Inclement Weather policy in 4. b. of these terms.
      13. Indemnification
        1. To the fullest extent permitted by law, in no event shall Poop Genie LLC, including its owner, members, employees, or representatives, be liable for any injury, death, loss, claim, damage, act of God, accident, delay, or any special, exemplary, punitive, incidental, or consequential damages of any kind, whether based in agreement, tort or otherwise, which arise out of or are in any way connected with any of our services.
        2. The Client agrees to defend, indemnify, and hold harmless Poop Genie LLC, its members, owners, employees, agents, and representatives, from and against any and all claims, damages, costs and expenses, including attorney’s fees, arising from or related to your use of our services.
      14. Governing Law; Venue; Attorney’s Fees
        1. Poop Genie LLC terms will be governed by the laws of the Commonwealth of Pennsylvania. Any action relating to service must be brought in the Court of Common Pleas of Dauphin County or the Federal Court for the Middle District of Pennsylvania, and both parties irrevocably consent to the jurisdiction of such courts.
        2. If either party brings an action against the other concerning the outcome, quality, or timeliness of our performance of services or other matters related to these terms, the party who prevails shall be entitled to recover her/his/its attorney’s fees and costs incurred in prosecuting such suit.
      15. By signing and approving a quote, the Client agrees to Poop Genie LLC terms. All updated terms and conditions will be sent to current Clients and commend September 1st, 2023.
